  • Upper and lower riparian: An upper-riparian State lies upstream and can affect the timing or quantity of flows reaching a lower-riparian State. Geography creates leverage but also responsibilities concerning notification, cooperation and avoidance of significant harm.
  • Run-of-the-river hydropower: Electricity is generated primarily from a river’s continuing flow, generally with much less storage than a large storage dam. It does not necessarily mean zero pondage, zero regulation or completely uniform downstream discharge.
  • Sediment flushing: Water is released through suitably placed low-level outlets to remove accumulated silt from a reservoir. It can restore storage and protect turbines but must be carefully timed and communicated because it temporarily changes downstream flow and sediment concentration.

Analysis

Why India Considers the Existing Framework Inadequate

India argues that the treaty reflects the population, engineering knowledge and water demand of the late 1950s. Punjab, Haryana and Rajasthan now face higher irrigation and drinking-water requirements, while groundwater depletion has increased the importance of surface-water utilisation.

Climate change adds variability rather than producing a single predictable reduction in flows. Altered snowfall, accelerated glacier change, extreme rainfall and longer dry periods increase the value of storage, flood moderation and flexible reservoir operations.

India also objects to what it regards as Pakistan’s systematic use of technical challenges to delay projects. Parallel recourse to different treaty mechanisms over the Kishenganga and Ratle projects illustrated disagreement not only over dam design but also over the appropriate forum for resolving that disagreement.

Hydropower and Water-Utilisation Plans

India is accelerating Chenab-basin projects including Sawalkot—1,856 MW; Pakal Dul—1,000 MW; Ratle—850 MW; Kiru—624 MW; and Kwar—540 MW. These projects are intended to support clean electricity, grid balancing and regional development while enlarging India’s effective utilisation of permitted western-river flows.

The Ujh multipurpose project concerns an eastern-river tributary and is designed to combine storage, irrigation, drinking water, flood moderation and hydropower. Such projects could reduce the quantity of India’s allocated eastern-river water flowing unused across the international boundary.

Existing projects also require sediment management. According to the article, the Salal reservoir’s effective storage declined sharply after its low-level outlets were plugged following Pakistani objections. Recent flushing at Salal and Baglihar indicates a shift towards restoring reservoir performance through modern operating practices.

Pakistan’s Water Stress: Upstream Flows and Domestic Governance

The article cites Pakistan’s National Water Policy to argue that large quantities reach the Arabian Sea while substantial canal water is lost through seepage and inefficient conveyance. Ageing irrigation systems, limited storage, water-intensive crops and weak demand management are therefore material components of Pakistan’s water crisis.
This does not make upstream management irrelevant.

A lower riparian depends on the timing, predictability and quality of flows, not merely the annual aggregate. Short-duration changes caused by pond filling, maintenance or sediment flushing can affect irrigation intakes and public perceptions. Transparent operational information remains strategically useful even when formal treaty cooperation is suspended.

Seasonal fluctuations must also be interpreted carefully. Chenab discharge can vary with snowfall, temperature and the timing of Himalayan snowmelt. A temporary fall or rise does not by itself prove intentional diversion or hostile manipulation.

Legal and Diplomatic Limits

“Abeyance” is not an operating category expressly defined by the treaty. Article XII states that the treaty may be modified through a duly ratified bilateral treaty and continues until terminated by another duly ratified treaty. India has separately invoked Pakistan’s cross-border terrorism, fundamental changes in circumstances and persistent obstruction to justify its position.

The legal effect of these arguments is not settled merely by their assertion. International law treats fundamental change as an exceptional ground, while Pakistan contests India’s power to suspend the treaty unilaterally. UPSC answers should therefore distinguish India’s official position from an internationally adjudicated conclusion.

India’s strongest case lies in technically defensible utilisation of its allocated rights, credible dam-safety requirements and evidence-based demands for treaty modernisation. Public rhetoric implying indiscriminate denial of water can weaken this case by reinforcing Pakistan’s lower-riparian narrative.

Way Forward

  • Complete projects already permissible under India’s interpretation of its basin rights while maintaining rigorous dam-safety and environmental appraisal.
  • Develop basin-wide data on glaciers, snowmelt, sediment, groundwater and climate variability.
  • Establish protocols for advance warning of operations that may create abrupt downstream fluctuations.
  • Separate counter-terrorism signalling from public claims suggesting collective punishment through water.
  • Frame any renegotiation around climate adaptation, modern engineering, dispute-resolution sequencing and reciprocal transparency.
  • Improve water-use efficiency within India so that additional infrastructure produces measurable water security rather than merely additional capacity.
